These Terms and Conditions ("Terms") govern your use of postpartum doula services provided by Agape Care Doulas ("we," "us," or "our") in Toronto, Ontario, Canada. By booking or using our services, you ("Client") agree to these Terms.
1. SERVICE DESCRIPTION
1.1 Services Offered
Agape Care Doulas provides professional postpartum support services including but not limited to:
• Emotional and physical support during the postpartum period
• Newborn care education and assistance
• Breastfeeding/lactation support and guidance
• Light meal preparation
• Household organization assistance
• Sibling care support
• Overnight care options
• Virtual consultations
1.2 Nature of Services
Our doulas are trained postpartum professionals providing non-medical support. We do not provide medical advice, diagnosis, or treatment. All medical questions should be directed to qualified healthcare providers.
2. BOOKING AND SCHEDULING
2.1 Service Reservation
Clients may book services through our website, email, or phone. All bookings are subject to doula availability and acceptance.
2.2 Consultation
We offer a complimentary initial consultation (virtual or in-person) to discuss your needs, preferences, and service options.
2.3 Service Agreements
Upon booking confirmation, clients will receive a service agreement outlining specific services, schedules, rates, and payment terms.
3. FEES AND PAYMENT
3.1 Service Rates
Current rates are available on our website and may be customized based on package selection, service duration, and specific needs.
3.2 Payment Terms
Payment is required according to the agreed schedule in your service agreement. We accept e-transfer, credit card, and other payment methods as specified.
3.3 Late Payments
Late payments may incur fees and may result in suspension of services until payment is received.
4. CANCELLATION AND RESCHEDULING POLICY
4.1 Client Cancellations
• Cancellations made more than 48 hours before scheduled service: Full refund or credit
• Cancellations made within 24-48 hours: 50% charge
• Cancellations made less than 24 hours: Full charge
• Emergency cancellations will be considered on a case-by-case basis
4.2 Our Cancellations
If we must cancel services due to doula illness or emergency, we will provide a replacement doula when possible or offer rescheduling with no penalty.
5. CLIENT RESPONSIBILITIES
5.1 Safe Environment
Clients must provide a safe, respectful working environment for our doulas, free from harassment, discrimination, or threatening behavior.
5.2 Accurate Information
Clients must provide accurate information regarding health conditions, allergies, pets, and household circumstances relevant to service provision.
5.3 Communication
Clients should communicate needs, preferences, and concerns clearly and promptly.
6. CONFIDENTIALITY AND PRIVACY
6.1 Privacy Protection
We respect your privacy and handle all personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
6.2 Information Use
Personal information collected is used solely for service provision and may include:
• Contact information
• Medical history relevant to postpartum care
• Household information
• Payment information
6.3 Client Confidentiality
All information shared during our services remains confidential except where disclosure is required by law.
7. LIABILITY AND INSURANCE
7.1 Professional Liability
Agape Care Doulas maintains appropriate professional liability insurance.
7.2 Limitation of Liability
We are not liable for:
• Medical complications or health issues (clients should consult healthcare providers)
• Loss or damage to personal property not caused by gross negligence
• Indirect or consequential damages
7.3 Emergency Situations
In case of medical emergency, our doulas will contact emergency services (911) and the client's designated emergency contacts.
8. SCOPE OF PRACTICE
8.1 Non-Medical Services
Our doulas do not:
• Provide medical advice or diagnosis
• Prescribe treatments or medications
• Perform clinical procedures
• Replace medical professionals
8.2 Referrals
We may recommend clients consult with appropriate healthcare providers, lactation consultants, or other professionals as needed.
9. BACKGROUND CHECKS AND QUALIFICATIONS
All Agape Care Doulas team members undergo:
• Background checks
• Reference verification
• Professional training and certification
• Ongoing education and development
10. TERMINATION OF SERVICES
10.1 Client Termination
Clients may terminate services at any time with written notice, subject to the cancellation policy.
10.2 Our Termination
We reserve the right to terminate services if:
• Payment terms are not met
• Unsafe or disrespectful working conditions exist
• Client misrepresents information
• Terms and Conditions are violated
11. INTELLECTUAL PROPERTY
All materials, resources, and content provided by Agape Care Doulas remain our intellectual property and may not be reproduced or distributed without permission.
12. GOVERNING LAW
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.
13. MODIFICATIONS
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the revision date. Continued use of our services constitutes acceptance of modified Terms.

15. SEVERABILITY

16. ENTIRE AGREEMENT
These Terms, together with your service agreement, constitute the entire agreement between you and Agape Care Doulas regarding our services.
By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
